These terms of use govern your access to and use of our AutoPay system (AutoPay).

These terms supplement the terms of use for our online systems (General Terms). In accessing or using AutoPay, you agree to be bound by and abide by these terms in addition to the General Terms.

Privacy

We collect personal information that you provide through AutoPay in order to administer access to and operate our online systems, and otherwise to carry out our functions and responsibilities under law, which include administering and enforcing Victoria’s taxation laws. We may also use your personal information to monitor your use of AutoPay and ensure you comply with these terms and the General Terms.

If you do not provide the information required, you may not be able to access or use AutoPay.

Where permitted by law, we may disclose personal information that you provide to other government agencies, including the Australian Taxation Office, other state and territory revenue offices and law enforcement agencies. This does not apply to bank details entered into AutoPay.

1. About AutoPay

AutoPay enables you to manage the payment of your assessment, by providing an online platform where you can:

  • set up an instalment schedule and specify the frequency at which your instalments will be paid
  • select your preferred payment method (for example, direct debit or credit card)
  • manage:
    • your direct debit or credit account details
    • your contact information, including details to enable you to receive electronic reminders and other correspondence from us in relation to your instalment schedule.

2. Payments

Once you have established an instalment schedule on AutoPay, the scheduled instalment amounts will be debited from your account until such time as the instalment schedule is completed or cancelled.

You are responsible for:

  • ensuring that there are sufficient funds in your account (or, in the case of a credit card account, sufficient credit) to pay each instalment in full when due
  • entering into AutoPay, and maintaining, accurate account and contact details during the term of the instalment schedule (including by updating those details on AutoPay where necessary).

3. Changes and overpayments

If you wish to change any of your account or other details after you have established an instalment schedule, you must do so one Business Day prior to the scheduled payment date or as specified in AutoPay.

If you wish to alter the instalment schedule for an assessment that is not overdue, you must do so one business day prior to the scheduled payment date or as specified in AutoPay.

You may not change your preferred payment method once you have established an instalment schedule. Instead, you must cancel your existing instalment schedule and establish a new one with the new payment method.

Any overpayment(s) that you make (for example, as a result of additional payments made by you) will not be automatically refunded to you. You must contact us about any such overpayment(s) (at the contact details set out on our website).

4. Cancellation of instalment schedule

Your instalment schedule will be cancelled immediately if a scheduled instalment amount is not received in full by us for any reason when that instalment amount is due to be received (for example, the account or credit card that you have nominated to be debited for the purposes of AutoPay has been closed or there are insufficient funds in the relevant account or insufficient credit on the relevant credit card). In the event of such a cancellation, you may be liable to pay the full outstanding amount of your assessment upon receipt of the notice of cancellation.

Your instalment schedule will also be cancelled immediately if an assessment in that instalment schedule has been withdrawn due to a change in, or the removal of, your liability. In the event of such a cancellation, you may need to establish a new instalment schedule.

Your instalment schedule for an overdue assessment may also be cancelled immediately if a subsequent assessment becomes overdue.

You will be notified via email if your instalment schedule has been cancelled (in general, within 24 hours).

You may cancel your instalment schedule through AutoPay. If you do not establish a replacement instalment schedule (for example, using a new payment method), you may be liable to pay the full outstanding amount of your assessment upon cancellation.

5. Access credentials

You may be granted access to AutoPay by entering the customer and assessment IDs that are set out in your assessment notice. However, AutoPay will not be available to all taxpayers and you will be advised if you are not eligible to use AutoPay when you enter your access credentials.

You may not disclose your access credentials to any other person, and you may not access AutoPay using another person’s access credentials, other than where a taxpayer has appointed another person to be their agent or adviser in relation to their tax affairs and the disclosure or access is for that purpose.

6. Notices

By using AutoPay, you agree to receive electronic communications from us, including emails, in relation to your instalment schedule.

All communications will be sent by us to the most recent contact details you have entered into AutoPay. You acknowledge that:

  • amendments to your details on AutoPay may require 24 hours to take effect
  • any amendments made within 24 hours of a communication from us may result in the communication being delivered to an out-of-date email address or not being delivered at all (and we will not be liable to you for any loss or damage should this occur).

7. Variation of these terms

We may change these terms from time to time. Despite our general rights to vary these terms under the terms of use of our online systems, if we reasonably consider that a change to these terms is likely to have a significant detrimental impact on you, we will make such changes to these terms no sooner than 10 days after we have notified you by email.

Your continued use of AutoPay following such notification will represent an agreement by you to be bound by and abide by the terms as amended. If you do not accept a change made by us to these terms, you must immediately cancel your AutoPay instalment schedule(s).

If we reasonably consider that a change to these terms is likely to benefit you or have a neutral or minor detrimental impact on you, we may change these terms immediately by publishing the amended terms in the AutoPay system or on our website, as set out in the terms of use of our online systems.

This section does not affect any obligation that we may have under the law, including the TAA, to give you notice of any change to these terms.
