Apply for a duty refund (reassessment)
Before you start
Exemptions, concessions and reductions should be claimed during the property transfer process. This form is for people who overpaid duty or were unaware of an exemption, concession or reduction at the time of transfer.
To avoid claiming a refund, apply for the exemptions, concessions or reductions via the Digital Duties Form at the time of purchase so you pay the correct amount of stamp duty.
If you overpaid duty on your purchase because you did not claim an exemption, concession or reduction you were eligible for, you can apply for a refund up to five years after the duty was paid.
You must complete the Duties Refund SmartForm and lodge it online via Duties Online or our public lodgement system.

Gather required information
The following information is needed to complete the Duties Refund SmartForm, but refer to the form for specific instructions:
- Full contact details of the buyer (all parties to be registered on title whether individuals, trusts or companies).
- Details of the title (refer to the certificate of title, plan of the property, transfer of land documentation, and council rate notice).
- Details of the transaction.
- Documents that prove the applicant is eligible for a refund.
- The bank account the refund should be deposited into, if a refund is applicable.
If you are applying for a farming or primary production related refund, you must also provide details about primary production on the land.

Complete SmartForm
Complete the SmartForm online, then print and sign your application.

Lodge form online
Scan your application and lodge it via the appropriate channel:
- Organisations must lodge the application, along with any attachments, via Duties Online.
- Individuals must lodge the application, along with any attachments, via our public lodgement system.
Paper-based submissions are not accepted.
Next Steps
Allow up to 60 days for a decision on your refund application.
- If you are entitled to a refund, we will deposit the amount into your nominated bank account.
- If you are entitled to a refund but have a tax debt with us, we will apply the refund amount to offset your debt and then pay any remaining amount into your nominated bank account.
- If your refund request is denied, we will write to you and explain why.
